Slovakia to File Lawsuit Against EU Over Russian Gas Ban, Fico Slams “Dysfunctional Strategy”
Prime Minister Robert Fico challenges Brussels’ voting mechanism and warns of "economic suicide" as energy prices surge amid Middle East crisis.

RATISLAVA, Slovakia — In a defiant challenge to European energy policy, Slovak Prime Minister Robert Fico officially announced on Friday that his government will file a lawsuit against the European Commission over its mandatory phase-out of Russian gas imports. Speaking from the capital, Fico characterized the EU’s Regulation 2026/261—which mandates a total decoupling from Russian energy by 2027—as a “dysfunctional strategy” driven more by geopolitical theater than the economic realities of Central Europe.
The Prime Minister, who has long been a vocal critic of the West’s approach to the Kremlin, doubled down on his skepticism of the sanctions regime with a provocative turn of phrase that has since echoed through European diplomatic circles. “If the Russians are on their knees, it is only because they are tying their shoelaces,” Fico remarked, suggesting that Western efforts to collapse the Russian economy have been fundamentally underestimated and poorly executed.
The legal challenge, which Slovakia intends to file at the Court of Justice of the European Union (CJEU) before the April 27 deadline, centers on the claim that the EU overstepped its authority by passing the gas ban through a qualified majority vote. Fico said the Slovak government views the move as a clear breach of the core principles underpinning EU treaties, stressing that decisions on sanctions and foreign policy should require unanimous agreement to protect the sovereign interests of member states.
We are here to ensure that Slovak households do not have to choose between heating their homes and putting food on the table because of a bureaucratic dictate from Brussels.

Justice Minister Boris Susko joined the Prime Minister in arguing that because energy security is a matter of national sovereignty, Slovakia should have retained its right to veto a policy that it claims will “impoverish” its citizens. “We are not here to serve an ideology of hatred toward a single supplier,” Fico stated during a televised address, reinforcing his stance against the mandatory energy transition.

The timing of the lawsuit comes at a moment of extreme volatility for global energy markets, particularly as the ongoing conflict in Iran disrupts traditional LNG supply chains through the Middle East. Landlocked nations like Slovakia find themselves increasingly dependent on the Druzhba pipeline for stability, as maritime alternatives become prohibitively expensive or physically blocked.
This geographic reality has fueled Fico’s argument that the EU’s “one-size-fits-all” energy transition is fundamentally flawed and ignores the specific vulnerabilities of Eastern member states. By labeling the attempt to cripple the Russian economy a “dysfunctional strategy,” Fico is positioning Slovakia as the primary defender of Central European energy interests, especially as the political landscape in neighboring Hungary shifts.
Beyond the legal technicalities, the Slovak government is also seeking an immediate interim injunction to halt the regulation’s enforcement while the court deliberates, a process that could span several years. This maneuver is viewed by many in Brussels as an attempt to create a legal “gray zone” that would allow Bratislava to continue its long-term energy contracts with Moscow indefinitely, regardless of broader EU mandates.
As the European Union enters negotiations for its 20th sanctions package, Slovakia’s move signals a deepening fracture in the bloc’s once-unified front against Russia. “We will not be the ones to commit economic suicide for the sake of a narrative that has clearly failed,” Fico concluded, signaling that Slovakia is prepared to use every legal and political tool at its disposal to maintain its energy status quo and national economic stability.
